Quick take: Understanding the importance of Aileen Cannon
In 2019, Chief Justice John Roberts made the astonishing, and either brazenly dishonest or stupidly naive claim that there is no such thing as a "Trump judge." Is there any such thing as an Obama judge? Maybe, maybe not, but if and when Trump reclaims the White House, I'm calling it here and now. Aileen Cannon just got herself a Supreme Court seat. She is the very model of a modern mincing Trump judge. Raymond Dearie ordered Trump's attorneys-- the idiots he could find to represent the lying-est liar who ever lied a lie, and never pays a bill-- to affirm the DoJ's document list, or provide evidence to the contrary. Problem: One of Trump's favorite lies has been that the FBI planted evidence, a lie so stupid and transparent that only a Ginni Thomas-level defective could fail to see through it. Cannon knows it's a lie. Moreover, Trump's lawyers won't go into the courtroom and claim the FBI planted evidence, because they'd get disbarred since they cannot even present a shred of evidence. They'd know they'd be lying, and a bar hearing would conclude that. But, Trump doesn't want to have his attorneys affirm the DoJ's list. Trap!
Unless Aileen Cannon saves him, for no legal reason, which is exactly what she did, because he wanted it. Cannon has done everything Trump asked, regardless of the contortions required. Quite a Supreme Court audition!
What lesson do we take? A Trumpist will never permit Trump to face legal consequences.
And all it takes is one.
As I have written repeatedly, the document theft and obstruction charges are the only crimes that have any chances of ever sticking to Trump. The Georgia investigation? Nope. Pick anything else, and he'll get away with it. January 6? No, Garland won't even think of bringing charges, because there is literally zero chance of conviction, and I detest misuse of the word, "literally."
What are the chances that Trump could face conviction on the document charges? I would put them as high as... 10%. You may think that sounds low, but I put his chances of conviction for literally anything else at literally 0. Literally. Also, "detest."
Why so low, when he is indisputably guilty? Aileen Cannon. Not her, personally, but what she represents. Trumpists worship him as a living god. One Trumpist on the jury, and that's it.
All it takes is one. Squishy Republicans? Maybe. A Trumpist? No.
Maybe I should reduce that to 5%. Or lower.
Trump's probability of conviction isn't about facts. It's about keeping loyal Trumpists off the jury.
The point of jury nullification is that jurors disregard facts and the law.
